These terms are an agreement between you and Comercio Digital Moli, S.A.P.I. de C.V. (“Binge”, “we”, “us”) for the Binge app and website, where you rate movies and shows and see what the people you follow think of them. By signing in to Binge you agree to these terms and to our Privacy Policy.
You must be 13 or older to use Binge. If we learn that an account belongs to someone under 13, we delete it.
In the iPhone app you sign in with Apple or with Google, so the security of your account depends on that Apple or Google account. If you created an account on the Binge website with an email address and a password, don’t share that password with anyone. You’re responsible for what happens on your Binge account. Use a name and username that don’t pretend to be someone else. You can delete your account at any time in the app: in Settings → Delete account; while you’re still setting up your profile, with the ⋯ button at the top of the screen; and, if your account is suspended, with Delete account on the suspension screen. If you use an email address and a password to sign in, you can also delete it on the website, in Settings → Delete account.
Binge is social. Your name, username, profile photo, ratings, posts and their notes, your top 5, who you follow, and your public lists are visible to anyone signed in to Binge, whether or not they follow you. Our Privacy Policy explains exactly what is visible and to whom.
You own the ratings, posts, notes, lists and photo you add to Binge. So that Binge can work, you give us permission to store that content and show it to other people on Binge as described above. This permission ends when you delete the content or your account. We don’t claim ownership of your content and we don’t sell it.
Only post things you have the right to share, including your profile photo.
Binge has zero tolerance for objectionable content and abusive users. Don’t post, in your profile, posts, notes or list names:
Binge filters some objectionable words automatically. You can report a post, a list or a user from inside the app, and block anyone so their posts and profile no longer appear for you and neither of you can follow the other while the block is on. Otherwise, blocking works only on your side: the person you block can still see what every Binge member can see. We review reports and remove content that breaks these rules, and we suspend or delete the accounts responsible. We aim to act on reports within 24 hours.
Don’t:
Movie and show information and artwork come from TMDB. This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB. Streaming availability data is provided by JustWatch. Trailers play from YouTube: Binge uses YouTube API Services, and by using Binge you agree to be bound by the YouTube Terms of Service. This information can be incomplete or out of date, and what’s available to stream changes by country and over time. Check with the streaming service before you rely on it.
Recommendations and Picks in Binge are suggestions based on your answers and ratings, not guarantees that you’ll like a title. Titles marked Promoted or Sponsored on the website’s Discover page aren’t based on your answers or ratings; everyone sees the same ones.
We may remove content, or suspend or delete accounts, that break these terms or put other people at risk. You can stop using Binge and delete your account at any time.
If you got Binge from Apple’s App Store or TestFlight: these terms are between you and us, not Apple. Apple isn’t responsible for Binge or its content, has no obligation to provide maintenance or support for it, and isn’t responsible for handling any claims about it; to the extent the law allows, Apple has no warranty obligation for Binge. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You may use Binge only on Apple devices you own or control, as Apple’s Usage Rules allow.
Binge is provided “as is” and “as available”, without warranties of any kind, and it may change, pause or stop. To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from your use of Binge. Nothing in these terms limits rights you have under the law that can’t be waived.
These terms are governed by the laws of Mexico. Any dispute about them will be resolved by the competent courts of Mexico City, unless the law of the country where you live gives you the right to bring it there.
If we change these terms, we’ll update the date at the top of this page. The Terms of Service link in the app always opens the current version. If you keep using Binge after a change, the new terms apply.
